Please read these Terms and Conditions carefully before engaging with the Zero Waste Pledge program supported by Zero Waste Malaysia. Your access to and use of the Zero Waste Pledge program conditioned on your acceptance of and compliance with these Terms. By accessing or using the Zero Waste Pledge, you agree to be bound by these Terms.
- Who are we
Zero Waste Pledge program is supported by Zero Waste Malaysia, a registered non-profit organisation (NGO) no. PPM-044-10-29032018 in Malaysia which advocates for sustainable development with the vision to increase the local community’s awareness in sustainable living. The Terms “we”, “us” or “our” in this document are also used to refer to Zero Waste Malaysia.
2.1 We reserve the right, at our sole discretion, to modify or replace these Terms at any time, in which case the amended Terms will be posted on the website and will apply from the date we post them. What constitutes a material change will be determined at our sole discretion. Please check these Terms on each occasion.
3.1 We treat and view all businesses and personal information seriously in accordance with all applicable data protection laws in Malaysia.
3.2 We reserve the right to reveal your business/organisation or any relevant information we have about your business/organisation if appropriate and in accordance with data protection.
4. Enrolment in Zero Waste Pledge Program
4.1 Details and Information
By enrolling in the Zero Waste Pledge Program, you certify that all information that you provided in the registration is accurate. Please ensure that the details you provide to us are correct and complete. You shall inform us immediately if there are any changes to the information that you provided when registering.
4.2 Zero Waste Pledge Certificate Validity Period
The Zero Waste Pledge certificate validity period is one (1) year or twelve (12) months. In order to extend the validity period, renewal of Pledge is required to be done annually.
4.3 Pledge Action
4.3.1 You are required to choose a minimum of one Pledge Action to be complied to from our suggested Pledge lists. You may suggest any Pledge Action that is deemed suitable for your organisation, however, it will be subject to our approval.
4.3.2 From the time a Pledge Action is first enrolled to the end of its term, it is referred to as a new Pledge Action. Once the term ends, it becomes an existing Pledge. The business / organisation may choose to retain the existing Pledge Action with or without adding a new Pledge Action in each renewal.
A fee is applied to the enrolment in Zero Waste Pledge program. Zero Waste Malaysia may, from time to time, launch other services which may be subject to a separate charge and terms.
4.5 Renewal of Pledge
Annual renewal is required to maintain the validity of the Zero Waste Pledge certificate and a renewable fee is applied.
Note: Business/Organisation that has been blacklisted by Zero Waste Malaysia cannot renew or enrol in the Zero Waste Pledge program.
4.6 Violation of Pledge
Your business/organisation will receive official warning statement/letter via email from Zero Waste Malaysia if we receive any complaint regarding violations on your business/organisation’s Pledge. For businesses that receive three (3) warnings for not fulfilling on any of the Pledge Action during that particular one-year pledge term, Zero Waste Malaysia reserves the right to terminate the endorsement immediately upon verification and investigation.
4.7 Termination of Pledge
We may terminate your enrolment at any time at our complete discretion but will generally only do so if you are in breach of the rules. Kindly refer to #6 for the Suspension and Termination of Pledge.
5. Intellectual Property Rights
5.1 You acknowledge that all marketing collaterals such as designs, images, text, data, audio, video, photographs and other material in Zero Waste Malaysia website or any material generated are owned by us. You are permitted to use the marketing materials only as expressly authorised by us.
5.2 The Zero Waste Malaysia (ZWM) name and logo are owned by Zero Waste Malaysia. No permission is given by us in respect of the use of any such names or logos and such use may constitute an infringement of the holder’s rights.
5.3 Whilst we encourage the business/organisation to campaign on the Pledge Action, please do not imply that you are taking action on behalf of Zero Waste Malaysia and in particular do not state that Zero Waste Malaysia is taking, or proposes or is considering taking action against any individuals or organisations, for example, boycott of a company’s products
6. Suspension and Termination of Pledge
6.1 By YOU
You can terminate your Pledge at any time through a prior thirty (30) days written notice to Zero Waste Malaysia. Such termination will result in the deactivation or disablement of your Pledge certificate. Termination will be confirmed immediately; the Pledge certificate is no longer effective unless you re-enrol a new Pledge in the next term. If you decided terminate the subscription in the middle of the period of the Pledge, you will not receive a refund.
6.2 By ZERO WASTE MALAYSIA
Zero Waste Malaysia may terminate your Pledge by providing at least 30 days’ prior written notice to you. For businesses that receive three (3) warnings for not fulfilling on any of the Pledge Action during that particular one-year pledge term, Zero Waste Malaysia reserves the right to terminate the endorsement immediately upon verification and investigation without any refund.
7. Re-enrol to Zero Waste Certification Program
For first time offenders, you are welcome to re-enrol to the Zero Waste Pledge program starting from the First Pledge. However, you will be suspended for (1) one year if we terminate your Pledge due to your repeat violation. Zero Waste Malaysia reserves the right, at our sole discretion to blacklist the organisation/business that being disqualified from the Zero Waste Pledge program for three (3) times or more.

At any time and at our complete discretion we reserve the right to withdraw the permission to make website links to our websites.
9. Limitations of Liability
Zero Waste Malaysia shall not be liable for any direct, indirect, incidental, special, punitive or consequential or other damages, lost profits, business revenue, goodwill, anticipated savings, or data, caused by the use of or inability to use the service even if the possibility of such damages has been advised.
